Member Ford told the subcommittee she was "incredibly... upset" after an interim superintendent presented what appeared to be the governor's bill late in session and before the board had an opportunity to review or vote on it. Ford said the presentation gave the impression "as though everybody was in agreeance with us and we hadn't even seen a draft of it," and cited AB 584 and SB 460 as examples of late-session items that complicated review.
Department staff and Amelia Thibo responded that when the department is asked to present a bill it does so but strives to remain neutral. Thibo said the proposed communications and rubric are intended to give the board earlier notice and clearer opportunities to indicate support, dissent, or neutrality and to authorize who may represent the board in testimony.
The subcommittee discussed guardrails to avoid future confusion and agreed the new process — weekly flagged communications, subcommittee review and the option to call special meetings — should reduce the chance a bill is presented without the board having seen a draft. The group will present the draft at the full board meeting for additional policy decisions, including how the board wants to handle displays of support when department staff is presenting.
