The court ultimately approved the motion to strike Item 1 on the contract modification document and carried the item 4–0.
The amendment had been countersigned by the City of Lucas and, after the change, will reflect the county's intent that the city's prior 90‑day notice — not the amendment language — triggers the termination date of Oct. 1, 2026. The court's action leaves open the option to add clarifying language stating the amendment does not waive liquidated damages, a fix county staff indicated would be acceptable to county attorneys.
