During the continued hearing, Attorney Baum announced a respondent exhibit (the CV of Christopher Hanes) filed since the last session. Department counsel objected on foundation grounds and because the witness tied to that CV was not expected to testify that day. Respondent counsel agreed the CV could wait until the witness was authenticated; the panel sustained the objection in part and kept the CV as "identification only" pending future authentication.
Separately, Department Exhibit 8 (the curriculum vitae of the witness the panel later qualified) had previously been proffered and questioned. After the panel qualified the witness, panel counsel recommended overruling the foundational objection and admitting the department's CV as a full exhibit; the chair overruled and admitted it as a full exhibit.
The record lists a sequence of written opinions and rebuttals entered as department exhibits with dates (for example, Department Exhibit 7 dated 02/01/2024, addenda and rebuttals dated 03/05/2024, 04/11/2024, 05/02/2024, 05/20/2024 and 06/13/2024 appear in the transcript as Exhibits 7, 10, 11, 12, 13 and 15 respectively). Those documents were discussed and several were adopted into the testimonial record by the qualified witness.
