At the third contested incident, officers ran a vehicle tag that returned to Jeff Council, who later arrived on the shoreline. Officers said records showed he had been trespassed from Menard May Park on May 13 and that they placed him in custody for trespass after warning and reissued an additional trespass.
Council told the magistrate he was placed in handcuffs and said the manner of restraint caused him to have a seizure in the back of a police car; he asked that officers be retrained on their handcuffing technique. The supervisor on duty, Sergeant Figuer, disputed Council’s description of policy violations and said medical personnel responded and offered a hospital evaluation that Council declined. Figuer emphasized that officers acted within city ordinance and state statute and that the department exercised discretion by issuing warnings in lieu of fines given Council’s circumstances.
The magistrate limited the hearing to trespass evidence and said any separate complaint over arrest methods or force would not be decided in this proceeding; he again promised a written ruling on the trespass matters within five days.
