The Rowlett Planning & Zoning Commission on Sept. 22 rejected a staff‑backed text amendment that would have allowed animal shelters to be considered in the C‑1 (Limited Commercial Retail) zoning district through approval of a special use permit. Planning Manager Lisonbee Duque told commissioners the change would not permit shelters by right and that each location would still require an SUP and public hearing.
Commissioner Hernandez moved to recommend the amendment to City Council; Commissioner Joe seconded the motion. During discussion several commissioners said they were sympathetic to the goal but felt they lacked critical data to make a code amendment. “I don't think we have enough information to make a decision on this item tonight,” the Chair said prior to the vote. The Chair announced the motion failed 4–3.
Supporters of the amendment said allowing shelters in C‑1 with an SUP preserves site‑specific review, while opponents argued rewriting the schedule of permitted uses without completed noise and site‑compatibility studies would preempt necessary protections for adjacent residential areas. Staff had said the SUP process would allow conditions related to access, operations, screening and hours, but several commissioners asked for more analysis before changing the development code.
The commission’s negative recommendation means the text amendment will not move forward to City Council as drafted; staff may revise the proposal or return with additional information if directed.
