Staff reports compliance at two sites; district court dismissed wetlands citations in one case

Conservation staff updated the commission on ongoing enforcement matters. At 50 Starlight Lane, the property owner met deadlines for installing straw waddles and an erosion control seed mix and remains in compliance with the enforcement order. At 31 Long Street, the owner has submitted removal protocols for a sand‑drift fence and stairs; staff will review the protocols and coordinate removal and any after‑the‑fact filings as appropriate.

Separately, staff told the commission that district court proceedings tied to the 150 State Highway wetlands citations were dismissed after the defendant claimed indigence and the judge waived the court fees. Staff said the town had not been notified prior to the hearing and is seeking town counsel guidance on next steps; the town is also discussing possible municipal‑lien authority for unpaid wetlands fines to strengthen enforcement options.

Commissioners expressed frustration that staff prepared for trials they were not told were being heard, and staff said they will follow up with the court and town counsel to determine options, including pursuing unpaid fines through civil remedies or superior court processes if feasible.
