The New Smyrna Beach Code Compliance Board heard a detailed history Sept. 17 of an unpermitted gazebo/pergola at 209 Robinson Road, a case that originated in September 2024 and progressed through permit review and an administrative-variance process. Officer Barbara Bobolak presented a timeline of permit reviews, variances and outstanding engineering comments; staff recommended compliance by Oct. 8, 2026, or imposition of a $50-per-day fine until the issue is resolved.
Property owner Jason Jimenez, who said he has worked with staff and tried to follow the permitting process, asked the board for more time and cited the cost of obtaining engineered drawings. "The drawings, you know, the structure is rock solid...but then they informed me that it'd probably be between 28 to $3,200 to get, design drawings on the structure that's already there," Jimenez said, describing the financial burden of securing engineering approval.
Board members discussed the lengthy review timeline and staff's repeated efforts to work with the owner; on a motion, the board granted a 30-day extension beyond the staff recommendation, setting a new compliance date of Nov. 8, 2026. The respondents were ordered to contact the code inspector to verify compliance and reminded they may appeal within 30 days after the order is issued.
