Mandy McKellar, the presiding officer appointed by the Clark County manager, opened a police fatality public fact-finding review and said the session was held because "the Clark County District Attorney's Office has made a preliminary determination that no criminal prosecution of the officers involved in the death of Bruce Ayer is appropriate." The review is required by Clark County Ordinance chapter 2.12 and is intended to present the public with the essential facts, McKellar said.
Chief Deputy District Attorney Morgan Thomas presented the review and introduced Detective Papix of the Henderson Police Department as the primary case agent. Michael Triano, appointed by the county manager as the ombudsman representing the public and the Ayer family, was given the opportunity to question investigators. The presiding officer emphasized that the proceeding "is not a trial" and that rules of evidence would not be strictly enforced for this public review.
Detectives summarized evidence including body-worn camera footage, crime-scene photos and witness interviews, and the forensic autopsy report that listed cause of death as multiple gunshot wounds and the manner of death as homicide. McKellar told attendees that the DA's investigation materials were provided to the ombudsman and the presiding officer and that the documents and a video of the proceeding are available as public record on the Clark County website.
The review produced no new criminal filing at the hearing itself; the DA's "preliminary determination" not to file charges was the procedural trigger for the public review required by county ordinance.
