The committee voted 5-0 to move CB77 favorable out of committee. Sponsor said the bill is intended to ease redevelopment of existing commercial structures in residentially zoned areas so they can house uses such as restaurants (without increasing the building footprint), childcare, or certain places of worship under standards intended to protect neighborhood character.
Planning staff and counsel warned of implementation issues and urged clarity on standards that permit staff can apply when reviewing building permits. David Warner, principal counsel, explained permit staff are not always in a position to make subjective determinations about neighborhood character and suggested adding clear standards to avoid unintended consequences for permitting. The committee asked for a map showing where the bill would apply and for explicit design and operational standards for permitted uses; staff said they would follow up.
The committee passed the motion to move the bill favorable, subject to technical follow-up and the expectation that clarifying language and mappings will be provided before final action.
