Regine Monastine, the special magistrate, accepted the village's recommendation and ordered fines to resume for an unpermitted canopy at 1441 South Treasure Drive, owner Jonathan Offerman.
Orlando Rodriguez, code enforcement director for North Bay Village, told the hearing the case had been before the magistrate at a prior hearing on Aug. 20. Rodriguez said the owner applied for a permit and received a variance for the canopy but still must provide engineering drawings requested by the building department. "This case was before you last hearing, August 20, and the property was ordered to comply with the violations and ordered to return today for a status report," Rodriguez said. The village asked that fines begin accruing at $2.50 per day until compliance is achieved.
Monastine said she would enter the order in accordance with the village's recommendation. The magistrate reminded parties that if they are found in violation, they may be fined and have 30 days to file a notice of appeal with the clerk of courts in Miami-Dade County. The owner or the owner's agent must submit the outstanding engineering documents and obtain the required permit to halt the fines.
