The Planning & Zoning Commission recommended that the city council adopt amendments to Chapter 106 of the La Porte Code of Ordinances to align local home-occupation rules with House Bill 2464, staff said.
Ryan Vietlick, Director of Planning & Development, explained HB 2464 (effective Sept. 1, 2025) preempts many local restrictions on "no-impact home-based businesses." Staff proposed edits including replacing the term "dwelling unit" with "residential property," removing a code provision that limited non-family employees, and explicitly preserving the city’s ability to regulate fire, building, health, sanitation, traffic, noise and off-street parking. Vietlick emphasized the city’s existing code largely reflects the state’s "no-impact" definition and that the proposal primarily updates language and preserves enforcement where state law allows.
Commissioners asked whether the changes would permit visible exterior business activities or multiple company vehicles parked on site; Vietlick reiterated that the proposal keeps the current prohibitions on outside storage and visible exterior evidence of a business and that allowed signage remains limited to one non-illuminated sign not exceeding 2 sq ft. After public input (none for this item) and discussion the commission voted to forward the amendments to city council with a recommendation of approval.
